This is an application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of bail.

The applicant came to be arrested in Crime No.476 of 2022 registered at Mohol Police Station, Solapur for the offence punishable under Sections 307, 323, 504, 506 r/w. 34 of Indian Penal Code. 3.

According to the prosecution, on 29th May 2022, the present applicant and other co-accused assaulted to the complainant - Pramod Shridhar Chavan, his parents and brother, by iron rod, sticks and sattor as they objected to the act of present applicant and other co-accused of digging of common boundary of their agricultural fields. I have heard the learned Counsel for the applicant and the learned APP for the State.

I have perused the injury certificates of the injured. The injuries are simple in nature. The applicant is in jail for more than four months. There are no criminal antecedents. The investigation is over. Considering these facts, I am inclined to release the applicant on bail. Hence, the following order is passed :

(i) Application is allowed.

(ii) The applicant - Mithu Sopan Chavan be released on bail in Crime No.476 of 2022 registered at Mohol Police Station, Solapur Karmala for the offence punishable under Sections 307, 323, 504, 506 r/w. 34 of Indian Penal Code on furnishing P.R.
