At the outset, the learned APP submits that in the present case, i.e. Sessions Case No. 390/15, the trial has commenced and the prosecution has examined as many as 5 witnesses till the date. It would not be appropriate to consider an application under section 439 of the Code of Criminal Procedure, 1973 during the pendency of the trial. Hence, the application stands dismissed and disposed of accordingly.
