Heard the learned counsel for the parties.

This application is preferred seeking relaxation of the condition of attendance imposed by learned Additional Sessions Judge, Borivali Division, Dindoshi by an order dated 8th October, 2020.

By the said order, while releasing the applicant on bail in C.R. No. 369 of 2018 for the offences punishable under sections 498-A, 377 and 379 of Indian Penal Code, 1860 and section 67-A of the Information Technology Act, 2000 the learned Additional Sessions Judge has imposed, inter alia, the following condition. "The applicant should attend Malad police station on every first Sunday of every month between 10.30 am to 2.30 pm till conclusion of trial".

The learned APP on instructions submits that the charge sheet has been lodged.

Having regard to the nature of accusations which is primarily against the brother of the applicant, the condition of attendance, at this length of time, appears onerous. Hence, the application stands allowed.

The condition of attendance stands relaxed.
