1] This is an application under Section 439 of Cr. P.C. for bail in CR No.I-80 of 2016 registered with Kashimira Police Station, Mumbai under Sections 307, 143, 144, 146, 147, 148, 149, 326, 323, 114 of the Indian Penal Code and under Sections 4, 25(1B) and 3(1) (ii), 3(2), 3(4) of the Maharashtra Control of Organised Crime Act, 1999. (M.C.O.C. Act). 2] It is alleged that when the applicant was on bail in CR No.359 of 2015 registered with Charkop Police Station under Sections 395, 406, 323, 506(2), 424, 34 of the Indian Penal Code and in CR No.27 of 2015 registered with Nalasopara Police Station under Section 336, 504 of the Indian Penal Code, has committed the present crime. 1/2

ba.1990-2017.doc 3] In view thereof, it is difficult for this Court to record a finding that the applicant is not likely to commit any offence while on bail as required under Section 21(4) of the M.C.O.C. Act. 4] I find no merits in the present application and is accordingly rejected.
