Heard learned counsel for the respective parties. 2.

The applicant along with other three accused have been convicted for committing murder of Samir Mustaf Sayyad @ Naikwadi for the ofence punishable under Sections 302, 364 and 201 read with Section 34 of the Indian Penal Code, 1860 and sentenced to sufer life imprisonment. Though the prosecution claimed that the incident is witnessed by four eyewitnesses, three eye-witnesses have turned hostile. The prosecution case is however supported by PW-9/Subhodh Rajkumar Shedbale, an eyewitness. In his deposition, PW-9 has specifcally stated that the present applicant along with other three convicted accused brought deceased Samir in injured state, carrying on the motor cycle and kept on the road. In the light of this evidence of PW-9/ Subhodh Rajkumar Shedbale, an eye-witness, we are not inclined to entertain this application for bail. 4.
