Learned counsel appearing for the respondent nos.1 and 2 invited my attention to the impugned order passed by the learned trial Judge. A perusal of the order dated 28th August 2014 passed by the learned trial Judge indicates that the learned trial Judge has not passed any order adjudicating the rights of the parties and has simplicitor adjourned the matter.

Appeal from order is not maintainable and is accordingly dismissed. In view of dismissal of the appeal from order, civil application does not survive and the same is accordingly disposed of. No order as to costs.
