The delay in filing of the Review Petition is condoned. Civil Application is accordingly disposed off.

In the Review Petition the following order is passed by consent: (i) Marriage Petition No. 2035 of 2017 filed by the original Respondenthusband --Rahul Arwind Ranware (Applicant/Petitioner in the above CA/Review Petition) shall be converted into a Petition seeking divorce by mutual consent.

KPPNair -2- (ii) The Respondent-husband shall pay an amount of Rs. 4,00,000/- (Rupees Four lacs only), by demand draft to the Original Applicant -- Anita Rahul Ranware in full and final settlement of all her claims against him within a period of eight weeks from today i.e. on or before 2nd November, 2017. The demand draft shall be drawn in favour of Anita Shamrao Jagdale; (iii) The parties shall appear before the Family Court at Bandra, on 3rd November, 2017, when the Court shall allow the parties to convert Marriage Petition No. 2035 of 2017 into a Petition by mutual consent and forthwith grant divorce by mutual consent of the parties. Before passing the decree of divorce, the Family Court at Bandra shall ensure that the demand draft of Rs. 4 lacs is handed over to the Applicant-wife.

(iv) The Respondent-husband shall file before this Court a petition seeking quashing of FIR Nos. 173/2013 and CC No. 2 (PW) 2014, pending on the file of 29th Court, Bhoiwada, Dadar, for offences punishable under Sections 498A, 406, 323, 504, 506 read with 34 of the Indian Penal Code, and shall move this Court on 6th November, 2017 when the Applicant-wife shall remain present and support/consent the quashing of the said case Nos. 173/2013 and CC No. 2 (PW) 2014.

(v) The shall withdraw all allegations against each other. (vi) Save and except what is stated hereinabove, the parties shall have no claim of whatsoever nature against each other.
