Heard learned counsel for the parties.
By this application, the applicant seeks his enlargement on bail in connection with C.R. No. 339 of 2018 registered with the Chembur Police Station, Mumbai for the alleged offences punishable under Sections 420, 465, 468, 471 read with 34 of the Indian Penal Code. Perused the papers. According to the complainant - Ram Shinde, the incident took place on 29.10.2018 when he along with another bus inspector Mr. Choudhary were checking tickets of passengers traveling 1/4
in the bus. The complainant has alleged that one passenger Pasha Shaikh showed his B.E.S.T. pass which was found to be suspicious and not a valid pass, pursuant to which Pasha Shaikh was asked to produce the receipt of the pass. It is alleged that, the Pasha Shaikh could not produce the said receipt. On investigation, it was found that the said pass was not issued by the B.E.S.T. but was a bogus pass, pursuant to which the aforesaid FIR was registered.
It appears from the investigation that Pasha Singh received the said pass from his employer Arjun Patil, who in turn had received the same from one Anurag Tiwari, who in turn again received the same from one Kushal Patil, who in turn had received the same from 'Trimax I.T. Infrastructure and Services Limited', who had a contract with B.E.S.T. for issuing B.E.S.T. bus passes. According to the learned counsel for the applicant, the applicant was appointed as a helper in the year 2017 in Trimax I.T. Infrastructure and Services Limited. Co-accused - Kushal Kailas Patil was enlarged on bail vide order dated 13.06.2019. It is not in dispute that Pasha shaikh, Arjun Patel, Anurag Tiwari and Kushal Patil have been enlarged on bail. The applicant has no antecedents. The 2/4
applicant is in custody for about 10 months. Investigation is complete and charge-sheet is filed.
Considering the aforesaid, the application is allowed on the following terms and conditions :
ORDER
(i) The applicant be enlarged on bail on furnishing P.R. Bond in the sum of Rs. 10,000/- with one or two sureties in the like amount;
(ii) The applicant shall inform his latest place of resident and mobile contact number immediately after being released and / or change of residence or mobile details, if any, from time to time to the trial Court as well as to the concerned Police Station, in writing; (iii) The applicant shall not tamper with the evidence or attempt to influence / contact the complainant, witnesses or any person concerned with the case.
(iv) The applicant shall co-operate in the conduct of the trial. 3/4
The application is allowed and disposed of in the above terms. It is made clear that the observations made herein are prima facie, and the trial Court shall decide the case on its own merits, in accordance with law, uninfluenced by the observations made in this order.
