The Petitioner, an employee of a private school was put under suspension from 7th October 2016 pending departmental proceedings. The Petitioner contends that since the departmental proceedings have not been concluded within the specified time frame, the Petitioner is entitled to claim reinstatement. The Petitioner is thus seeking a direction to the respondent institution to reinstate him in employment and to release the amount towards the unpaid salary. It has not been disclosed as what is the outcome of the departmental proceedings initiated against the Petitioner.

It would be open for the Petitioner, in the event of issuance of any adverse order at the conclusion of the departmental proceedings to take appropriate steps in accordance with The Maharashtra Employees of Private Schools (Condition of Service) 1977. It would also be open for the Petitioner to claim the ancillary reliefs those have been claimed in the instant petition. 3.
Keeping open the liberty to the Petitioner to avail of appropriate remedies available in law, the Writ Petition is disposed of.
