The two applicants before me are the son and grandson of Bhupendra Shah. The basis on which the applicants are arraigned as accused can be discerned from the complaint, as it is alleged that some amount has been transferred by accused No.1 into their accounts.

Learned counsel for the applicants states that an amount of Rs.3,75,000/- has come to their account and they had already furnished a DD of the said amount to the Investigating Officer.

Learned A.P.P. Mr.Gavand does not dispute the said statement.

Considering the limited role attributed to the present applicants and, since, they have already parted with the amount, which was received by them into their account, their custodial interrogation is not necessary.

: ORDER :

(a) Application is allowed.

(b) In the event of arrest in connection with C.R.No.I-94 of 2022 registered with Gavdevi Police Station, applicant No.1-Bhavesh Bhupendra Shah and applicant No.2-Aadesh Bhavesh Shah shall be released on bail on furnishing P.R. Bond to the extent of Rs.25,000/- each, with one or two sureties in the like amount. (c) The applicants shall report to the concerned police station on 27th and 28th October, 2022 between 3.00 p.m. to 5.00 p.m. and, thereafter, as and when called for. (d) The applicants shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing the facts to Court or any Police Officer and shall not tamper with evidence.
