Learned counsel for the petitioner submits that the question involved in this case has been considered and decided by the Division Bench of this Court in the case of Shri. More Rajendra Ashokrao Versus State of Maharashtra in WP No. 8330 of 2014. In view of the aforesaid, we dispose of this petition by quashing the impugned order dated 7.8.2014 passed by respondent no.1 Education Officer, Secondary, Zilla Parishad, Solapur. The concerned respondent to release the salary, if it is withheld based upon the impugned order as expeditiously as possible and preferably within the period of six weeks from today, by following due process of law.
