Heard the Learned Advocates appearing for the parties. Following order is passed, by consent.

(a) The Hindu Marriage Petition No.137 of 2017 filed by the Respondenthusband before the Court of Civil Judge, Senior Division at Nashik is transferred to the Family Court at Bandra, Mumbai and directed to be heard alongwith M.J. Petition No.2361 of 2016 filed by the Applicant-wife seeking dissolution of marriage between her and the Respondent.

(b) The Family Court at Bandra shall allow the Respondent-husband to conduct the proceedings through video-conferencing. (c) The District Court at Nashik shall allow the Respondent to use the video-conferencing facilities.

kpd 2 / 2 907-MCA-256-2017.sxw (d) The Respondent shall appear before the Family Court at Bandra, Mumbai if only when the Family Court at Bandra, Mumbai feels that his presence is required before the Court.

(e) The Respondent shall be at liberty to affirm, verify his pleadings/affidavits before the District Court/Family Court at Nashik and forward the same to the Family Court at Bandra, Mumbai which the Family Court at Bandra, Mumbai shall accept.

(f) Since the proceedings shall be conducted through video- conferencing, the Family Court at Bandra, Mumbai shall fix the hearing of the matter at the time specified in advance.

(g) The Family Court at Bandra, Mumbai shall endeavour to dispose of Hindu Marriage Petition No.137 of 2017 alongwith M.J. Petition No.2361 of 2016 within a period of six months from the date of this order. (h) The Family Court at Bandra, Mumbai shall not grant any adjournment to the parties unless absolutely necessary. The parties too shall not seek any adjournment unless absolutely necessary.

(i) All contentions of the parties are kept open. 3.

The above Miscellaneous Civil Application is accordingly disposed off. ( S.J.KATHAWALLA, J. )
