By this First Appeal, the Appellant/Original Plaintiff is challenging the judgment and decree dated 27th July 2015 passed by the Bombay City Civil Court, Bombay dismissing L.C.Suit No. 1579 of 2009. 3.

Considering the submission made by the learned counsel for the Appellant and impugned judgment and decree I am satisfied that the Appellant has made out the case for following order: a.
