Heard the learned Advocate for the Appellant. M.K.Kocharekar, the learned Advocate waives notice for Respondent No.2.

My attention is drawn to order dated 10th April, 2017, passed in criminal Application No. 112 of 2016 whereby in the application filed by the State challenging acquittal of Respondent No.1 herein, the leave is granted. Appeal of the State is admitted and action under Section 390 of Cr.P.C. has already been taken against present Respondent No.1. Hence, leave in the instant matter is also granted.

Admit. However, action under section 390 of Cr.P.C. need not be taken against Respondent No.1 again. 4.
Put up for hearing alongwith the appeal filed by the State in pursuant to the leave granted by the Criminal Application No.112 of 2016.
