The appearance in order dated 1st September 2021 be corrected. Learned advocate who is shown to have appeared for the applicant, had actually appeared for respondent nos.2 to 6. 2.

Learned advocate Mr.Sathe submit that respondent nos.2, 5 and others had preferred Criminal Writ Petition No.1215 of 2018 and Writ Petition No.1214 of 2018 for quashing the proceedings. By order dated 2nd November 2020 learned APP appearing for the State, MANISH SURESH THATTE MANISH SURESH THATTE Date: 2021.09.17 10:02:53 +0530 on instructions, submitted that `B' summary report is filed before the concerned Court. The Court has recorded statement of learned APP. The order passed in the said petitions further indicate that counsel for petitioners submitted that petitions will be withdrawn and they would participate in `B' summary proceedings before the concerned Court. It is submitted that CR No.55 of 2018 which is subject matter of this application, was under challenge in the aforesaid writ petition. He further pointed out order dated 9th April 2021 passed by learned JMFC, Kalyan in CR No.55 of 2018 allowing the application for `B' summary.

In view of aforesaid circumstances, this application for cancellation of anticipatory bail granted to the respondents vide order dated 28th March 2018 is devoid of merits. I have perused the impugned order which reflects that detailed reasons were assigned by Court while allowing the application. Hence, Criminal Application is rejected.
