At the outset, learned counsel for the applicant does not press for prayer clause (b). Learned Counsel submits that the applicant be permitted to furnish two sureties of Rs.15,000/- each to make up the amount of Rs.30,000/-, instead of PR Bond of Rs.30,000/- with one solvent surety in the like amount, as directed by the learned Additional Sessions Judge, City Civil and Sessions Court, Borivali Division, Dindoshi, vide order dated 4th August, 2017.

It appears that the applicant is in custody, despite the order dated 4th August, 2017, as he is unable to furnish one solvent surety of Rs.30,000/-, as directed by the learned Additional Sessions Judge, City Civil and Sessions Court, Borivali Division, Dindoshi. 3.

Considering the aforesaid, in the interest of justice, the application is allowed and the condition imposed by the learned Additional Sessions Judge, City Civil and Sessions Court, Borivali Division, Dindoshi, in para 9, clause - 2 of the order dated 4th August, 2017, directing the applicant to be released on bail on execution of PR Bond of Rs.30,000/-, with one solvent surety in the like amount is modified. The applicant shall now be released on bail on execution of PR Bond of Rs.30,000/-, with two solvent sureties to make up the said amount of Rs.30,000/-. Rest of the conditions imposed vide order dated 4th August, 2017, to remain as it is. 4.

The applicant is, however, at liberty to file an appropriate application for modification/relaxation of the condition set out in clause - 3 of para 9 of the aforesaid order dated 4th August, 2017, as and when the need so arises.
