1] By an Order dated 21st August 2018, the applicant was granted interim relief and was directed to attend the Investigating Officer on stipulated dates, to join the process of investigation. The learned APP on instructions submitted that the applicant has complied with the said direction.
2] Perusal of the record of investigation would indicate that, the applicant has deposited the alleged amount of rupees one lakh during the course of investigation. It is the allegation against the applicant that, he took rupees one lakh from the informant and/or her parents towards dowry 1/2
aba.1626-2018.doc in the month of January 2014.
3] After perusing the record and after taking into consideration the fact that the apploicant has deposited rupees one lakh with the Investigating Agency, this Court is of the view that the custodial interrogation of the applicant for further investigation of the present crime is not necessary.
In view thereof, interim relief granted by Order dated 21st August 2018 is hereby confirmed. However, the condition to attend the Investigating Officer is waived.
