This is an application fled under Section 439 of Code of Criminal Procedure, 1973 for bail.

The applicant came to be arrested in Crime No.233 of 2022 registered at Mohol police station, Solapur for the ofences punishable under Sections 498-A, 306 read with 34 of the Indian Penal Code.

The deceased Rutuja was the wife of the present applicant. According to the prosecution, on 20 March 2022, the deceased committed suicide due to ill-treatment of the present applicant and other co-accused.

I have heard the learned counsel for the applicant and learned APP for the respondent / State.

The allegations are that as the deceased was not able to perform household work the present applicant and other coaccused used to ill-treat her. There are no allegations of demand of money. Prima facie from the material in the charge-sheet, it is difcult to infer that there was no option for the deceased except to commit suicide.

Considering these facts and circumstances, I am inclined to release the applicant on bail. In the result, the following order is passed.

O R D E R

A] Bail Application is allowed.

B] The applicant be released on bail in C.R. No.233 of 2022 registered at Mohol police station, Solapur for the ofences punishable under Sections 498-A, 306 read with 34 of the IPC on furnishing P.R Bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand) with one or two sureties in the like amount.
