The Petitioner is original complainant who has filed the application before the Court of learned Railway Mobile Court at Andheri for issuing directions under Section 156(3) of Code of Criminal Procedure. The said proceedings are filed before the Court on 11th August, 2022. It is submitted that learned Magistrate has posted the application for hearing on 21st October, 2022. The delay in issuing directions under Section 156(3) of Cr.P.C. may cause prejudice to the investigation to be carried out since expeditious investigation is necessary in the facts of this case. It is therefore, prayed that, learned Magistrate be directed to decide the complaint/application preferred by the application, qua issuing direction under Section 156(3) of Cr.P.C. before the next date of hearing.

Considering the facts that, the applicant/petitioner is seeking direction under Section 156(3) of Cr.P.C, the learned Magistrate is requested to proceeded with the application seeking direction under Section 156(3) of Cr.P.C. On 21st October, 2022 or within a period of three weeks from thereafter.

It is clarified that this Court has not dealt with merits of the case and direction is only to decide application expeditiously on merits.
