The challenge in this application is to the order dated 26 August 2022 whereby the application moved by the Applicant/original complainant for permission to adduce additional evidence. The matter was, in fact, posted for arguments. The trial court has found the application to have been moved only with a view to meet the defence version that appeared during the evidence of the Respondent/accused. It was the case of the Respondent/accused that the
sg 2/2 23.apl931-22.doc Applicant/complainant has stolen his 24 cheques. Therefore, to meet the same, the Applicant had moved the application. It appears that except the oral version of the Respondent/accused before the trial court, there was nothing in support of her contention. 4.
In view of the same, the application stands disposed of. The trial court is expected to decide the matter on merits within a time-frame of three months from the date of receipt of copy of this order.
