Heard the learned counsel for the applicant and the learned APP for the State.

This application is preferred seeking pre-arrest bail in connection with C.R. No.237 of 2022 registered at Kothrud police station for the offences punishable under sections 406 and 420 of Indian penal Code, 1860.

By an order dated 6th September, 2023 this Court was persuaded to grant interim protection. It is submitted that the amount has been credited to the account of co-accused Gopalbhai and another co-accused, who has already been granted pre-arrest bail, weighed with this Court. Having regard to the punishment which the offence under section 420 of the Code entails, the custodial interrogation of the applicant does not seem to be warranted for an effective investigation. I am, therefore, impelled to make order of interim bail absolute.

The order of interim bail dated 6th September, 2023 is made absolute on the terms and conditions incorporated therein. 6.

Henceforth, the applicant shall attend Kothrud police station as and when directed.

7.

The applicant shall not tamper with the prosecution evidence and give threat or inducement to first informant, any of the prosecution witnesses or any person acquainted with the facts of the case.

8.

The applicant shall regularly attend the proceedings before the jurisdictional Court.

9.

It is clarified that these prima facie observations are confined to determine entitlement to pre-arrest bail only. Application disposed.
