None for the Petitioner. Heard Mr. Saste, learned APP for the State. We have gone through the impugned order. It appears that learned Magistrate has not issued order under section 156(3) of the Code of Criminal Procedure, 1973 but has decided to proceed under section 200 of the Code of Criminal Procedure, 1973. The discretion is with the Magistrate to direct investigation or to proceed under any other provision. The order is discretionary one. We do not see any reason to interfere with the said order.
