Heard Mr. Khot, learned Counsel for the Applicant and Mr. Chaudhari, learned APP for the Respondent-State. 2.
Mr. Khot, learned Counsel for the Applicant, after arguing the matter for some time, and as this Court was not inclined to grant bail, sought withdrawal of the Bail Application. However, he stated that the Applicant is incarcerated since 23rd April 2023 and that there is no progress in the trial.

The offence is punishable under Sections 376(2)(n), 376(3), 354-A and 354-B of the Indian Penal Code, 1860 and 4, 6, 8, and Sonali
8-BA-2395-2023.DOC 12 of the Protection of Children from Sexual Offences Act, 2012. All the victims are students of class 8. The Applicant is the Class Teacher. Mr. Chaudhari, learned APP stated that one of the incidents has been captured and filmed and that the details of the said video is at page No.75.

In the facts and circumstances of this case, the learned Trial Court is requested to expedite and conclude the trial within a period of one year.

The Applicant is granted liberty to prefer a fresh Bail Application after a period of one year in case there is no substantial progress in the trial.
