Learned APP on instructions from Superintendent, Yerawada Open District Prison, Pune submitted that, when the Petitioner was released on Covid-19 Emergency Parole Leave he got admitted at Criticare Lifeline Hospital, New Mumbai for Covid treatment in the month of March 2021. That, the said hospital has charged for certain amount for his treatment and the Petitioner has prayed for refund of the said amount. 2.

The Petitioner is having substantive alternate remedy for the recovery of the amount charged by the said hospital before the appropriate Court/Forum.

According to us, present Criminal Writ Petition is therefore not maintainable and is disposed off.
