Appellants had filed a petition for divorce under the under Section 13(1)(i-a) of the Hindu Marriage Act, 1956 which was dismissed on the ground that it is not maintainable since the Petitioner is a Hindu and the Respondent is a Christian. The learned counsel appearing for the Appellant seeks leave to withdraw this appeal with liberty to file petition for divorce under the Special Marriage Act, or any other special marriage Act.
