Heard learned counsel for the petitioner.

Learned counsel for the respondent pointed out that the main proceedings before the Family Court, Pune stand dismissed as the petitioner-husband failed to deposit the arrears as directed by the Family Court. The present petition arises out of an interim order of maintenance granted by the Family Court. Consequent to the dismissal of the divorce petition before the Family Court, the question of considering the challenge in this petition to the interim order passed by the Family Court now does not arise.

In the event the proceedings before the Family Court are restored, liberty to apply to the petitioner for restoring this petition. Keeping this liberty open, the petition is dismissed.
