1] Heard learned counsel for the respective parties. 2] The record indicates that, the application filed by the applicant/original defendant under Section 9A of the Code of Civil Procedure, 1908 (Below Exhibit 13) in R.A.D. Suit No. 1208 of 2016 is still pending on the file of the learned Judge of the Small Causes Court, Mumbai for final adjudication. In view of the facts of the present case, it will be appropriate and desirable that, the said application can be heard 1/2
AHG 20-CRA-51-18.odt as expeditiously as possible. Till that time, the order dated 26th April 2017 granting interim injunction in favour of respondent/original plaintiff, to remain in force.
In view of the above, the learned Judge, Small Causes Court, Mumbai seized of R.A.D Suit No.1208 of 2016 is hereby requested to conclude the hearing of the said application filed below Exhibit 13 filed under section 9A of Civil Procedure Code within a period of 8 weeks from today.
