Learned AGP tendered Affidavit of Respondent No.2 and submits that the reference is already made under Section 3H of the National Highways Act, 1956 vide Reference Case No. LRMA 2/2018 and same is now pending on the file of Civil Judge, Senior Division, Nashik. 2.

In view of reference already made for adjudication of rival claims, no cause survives to proceed with the Petition. Accordingly, the Petition is disposed of with direction to Reference Court to decide the Reference as expeditiously as possible and preferably within nine months from the date of this order.
