Heard Ms Mukherjee, learned Counsel for the petitioners. 2.

Ms Mukherjee has tendered photocopy of Purshis dated 26.04.2019 filed on behalf of the defendant in Marji Application No.887 of 2012 in R.A.E.Suit No.625/934 of 2009 in the Small Causes Court, Mumbai. The same is taken on record and marked 'X' for identification. In the Purshis, defendant has stated that the plaintiffs and the defendant have settled the matter out of Court. The defendant has surrendered his tenancy rights. The defendant, therefore, does not wish to proceed with the Marji Application. Defendant withdrew Marji Application. 3.

In view thereof, Ms Mukherjee seeks permission to withdraw the Petition on the ground that the matter is settled between the parties out of Court.

On the motion made by Ms Mukherjee, Petition is allowed to be withdrawn and is disposed of as such. Rule is discharged with no order as to costs.
