This is the second anticipatory bail application preferred by the applicant. On 28th August, 2015 the very same applicant had preferred an Anticipatory Bail Application and when this Court was not inclined to grant any protection to the applicant, the applicant did not press the application qua the said applicant - Sayyad Masud Ali Khatib @ Ali. It is clearly stated in the said order dated 28th August, 2015 that after arguing for some time, learned counsel for the applicants does not press the application qua applicant no.2 - Sayyad Masud Ali Khatib @ Ali. 2.

Infact, the learned counsel for the applicant had made a

2/2 929-aba.1347.2015.doc statement that the applicant - Sayyad Masud Ali Khatib @ Ali will surrender before the Sadar Bazar Police Station, Solapur on 31st August, 2015 and the said statement was accepted and the same is recorded in the order dated 28th August, 2015.

It appears that inspite of the said statement, the applicant Sayyad Masud Ali Khatib @ Ali has not surrendered yet. It is extremely unfortunate. There is only a change in the lawyers appearing for the applicant.

Considering the serious allegations as against the applicant, this Court was not inclined to consider the prayer for Anticipatory Bail and hence the learned counsel who appeared then for the applicant did not press the application qua the present applicant.

Hence, there is no merit in the said application. The application accordingly stands rejected.
