1] The learned Counsel appearing for the respondent No.2 submitted that, during the pendency of the present petition, the parties herein have amicably settled the matter and have filed the consent terms before the Civil Court in that behalf. He submitted that, in view of the said consent terms, the present petition does not survive. The learned counsel for the petitioner condeded to the same.

2] In view of the statement made by the learned counsel for the respondent No.2.proceedings i.e. CC No.26/SS/2005 pending on the file of the Metropolitan Magistrate, 22nd Court, Andheri, Mumbai is hereby quashed and set aside.
