IN THE HIGH COURT OF JUDICATURE AT BOMBAY
CRIMINAL APPELLATE JURISDICTION BAIL APPLICATION NO. 2728 OF 2022 Gulab H. Gupta ...Applicant vs.
The State of Maharashtra
...Respondent
Mr. Praveen C. Jha, for the Applicant.
Mr. H. J. Dedhia- APP for the Respondent-State. CORAM : S. M. MODAK, J.
DATED : 3RD MAY 2023 P. C. :
1.
When the matter is placed before me, the learned APP has pointed to me the order dated 28th January, 2022 passed in Criminal Bail Application No.3984 of 2021 preferred by this applicant only. It says that when this Court presided over by (Quorum Sarang V. Kotwal, J.) was not inclined to grant relief, there was a prayer for withdrawing of this Application unconditionally. 2.
It further mentions that the applicant is in custody since December 2016. In view that the trial was expedited. 3.
Now contention is raised that inspite of the said directions even though the Trial Court has started, it is not finished. When 1/2
902.BA.2728.2022.doc learned APP made this submission, learned counsel for the applicant contended that even this application is pending for Nine months and infact the registry of this Court ought to have directed this application to be placed before the concerned Court. 4.
I do not find that this submission is acceptable. It is for the reason that the order passed by Hon'ble Acting Chief Justice are published on the website. So atleast the applicant ought to be aware of such orders.
5.
At this stage, the learned Advocate for the applicant wishes to withdraw this Application. Even it is again asked to learned Advocate, whether he wants he wants to withdraw this application or whether necessary direction be given to the office, he reiterated for withdrawal.
5.
Hence, Application is disposed of as withdrawn. [S. M. MODAK, J.] 2/2
