By this petition, the petitioner has challenged the order dated 29th July, 2016 passed by the learned Judicial Magistrate, First Class, 1st Court, Kalyan. The petitioner have alternative efficacious remedy of filing the revision application before the Sessions Court. 2.

Considering the above fact, Ms. Mrunmai Kulkarni, learned counsel for the petitioner seeks leave to withdraw the petition with liberty to file revision application and application for condonation of delay, if necessary.

Leave with liberty is granted. Writ Petition No. 3454 of 2017 is dismissed as withdrawn.
