This Application is preferred by the original opponent No.2 for condonation of 39 days delay in filing the appeal challenging the judgment and award dated 13/03/2012 passed by the MACT Nasik in MACP No.305/2009.

The learned counsel for the Respondent original claimant makes a statement that they have no objection if the delay is condoned.

Considering the submissions made by the learned counsel for the Applicant, the averments made in the Application and as the learned counsel Basavraj G Patil 1/2

9.3617.12-caf for the Respondent has no objection if the Civil Application is allowed, I am satisfied that the Applicant has made out a case for allowing the present Civil Application. Hence, the following order:

A) Civil Application is allowed in terms of prayer clause (a) which read thus;

(a) That the delay in filing the appeal of about 39 days in filing the present Appeal be condoned.

B) Civil application stands disposed off accordingly.
