Heard the learned APP appearing for the Respondent/State. The learned APP informs this Court that after a full-fledged trial, the Petitioner has been convicted by the Trial Court The Petitioner has filed his application addressed to the Hon' ble the Chief Justice of this High Court, wherein he raised serious grievance about the ill-treatment and assault committed by the police when he was in police custody as a under-trial prisoner.

It is true that the said allegations were made way back in the year 2015. However, in the peculiar facts of this case, we deem it appropriate to direct the Commissioner of Police, Mumbai to cause an inquiry into the lgc

(1) wp-3628.15.odt allegations made by the Petitioner in his application. Such an inquiry would be conducted within a period of 10 (Ten) weeks from the date of receipt of the case of this order. Depending upon the out-come of the inquiry, the Commissioner of Police, Mumbai would be free to take a decision and/or action, if any, against the said police officer who were indulging in ill-treatment and assaulting the Petitioner. After conducting and completing the inquiry, the Commissioner of Police, Mumbai shall submit a report to this Court. The Registry shall forward a copy of the Application from page Nos.1 to 3 as also the copy of this order to the office of the Commissioner of Police, Mumbai so as to reach the same to the said office within a period of one week from today.

With the above directions, the Writ Petition stands disposed of. List the Petition under the caption "For compliance" on 26/09/2022.
