The application seeks condonation of delay in preferring the First Appeal against the judgement and award dated 4th January 2018 passed by the learned Civil Judge, Senior Division, Alibag in L.A.R. No. 64 of 2016. The delay is of 1 year and 13 days. 11th January 2024

The record indicates that the notice has been served upon the Respondents, however, none appears for them.

In paragraph 3 of the application, delay has been explained in detail. The reasons mentioned in the application are justified. Hence, I am inclined to allow the application. The delay of 1 year and 13 days in preferring the First Appeal is condoned. 4.
Interim Application No. 116 of 2020 stands allowed. Accordingly the First Appeal is directed to be registered. 5.
In view of foregoing, Interim Application No. 117 of 2020 is allowed in terms of prayer clause (b), which reads thus, "b) That this Hon'ble Court be pleased to stay the execution, operation and implementation of the judgement and award dated 4th January 2018 passed by the learned Civil Judge, Senior Division, Alibag in Land Reference No. 64 of 2016, till the hearing and final disposal of the First Appeal."
