Heard the learned Counsel appointed for the applicant and the learned APP for the State.

The learned counsel for the applicant submitted that the applicant has been arraigned as an accused in C.R.No. 124/2014 under section 376 of IPC and other allied sections. The applicant is arrested on 20.3.2014. She submitted that after reading the application sent through jail, prima facie, it appears that the applicant has been falsely implicated in the present crime by his first wife. She further submitted that the applicant either may be released on bail or his trial may be expedited. The learned APP, on instructions, submitted that in the present case i.e. in Sessions Case No. 61/2014, the charge has already been framed and witness summons have been issued.

After taking into consideration the fact that the applicant is arrested on 23.3.2014, a direction to the trial Court to expedite the trial will meet the ends of justice.

ORDER :

The learned Additional Sessions Judge, Dindoshi seized of the trial pertaining to Sessions Case No. 61/2014 registered with Dindoshi Police Station, Mumbai is hereby directed to make an endeavour to expedite the said trial and to conclude the same as far as possible on or before 31.12.2016.

Registry is directed to send the copy of this order to the applicant who is lodged at Taloja Central Prison.
