The learned counsel for the respondent, upon instructions submits that applicant has filed an application through jail to this Court directly and that no application seeking enlargement on bail was filed before the Special Court. It is also submitted upon instructions that the trial has commenced in Special Case No. 63 of 2015.

2) It would not be appropriate to consider the application under section 439 of the Code of Criminal Procedure, 1973 in the midst of trial.
