The learned counsel for the applicant on instructions submitted that during the pendency of the present application, the Police have filed chargesheet in the present case i.e in CR No.27 of 2013 registered with Dharavi Police Station, Mumbai under Section 420 of Indian Penal Code. He submitted that the present application was filed against Order passed by the Trial Court under Section 457 of Cr. P.C.. He further submitted that since the chargesheet is now filed, he will prefer fresh application before the Trial Court under Section 451 of Cr. P.C. and in view of the same, he seeks leave to withdraw the present application.

Dond 1/2 apl.869-2013.sxw The application is allowed to be withdrawn with liberty to file fresh application before the Trial Court under Section 451 of Cr. P.C. Interim relief granted by this Court by order dated 17.9.2013 will remain in force only for a period of two weeks from today. By keeping all contentions of the parties open, the application is disposed off in the aforesaid terms.
