Heard. By this petition under Article 227 of the Constitution of India the Petitioner plaintiff challenges the order dated 08.08.2013 passed by the Civil Judge, Senior Division, Sangola below Exhibit- 29 in Regular Civil Suit No.286/2012 rejecting the application made by the plaintiff for appointment of court commissioner.

After arguing for some time, the learned counsel for the petitioner seeks permission to withdraw the Writ Petition with liberty to file appropriate application for the same cause of action after recording evidence of both the parties. To that effect, he made an endorsement on a farad. Same is taken on record and marked "X" for identification.
