Heard Shri Prashant Gurav, the learned counsel for the applicant / appellant.

It was decided that the appeal itself should be heard and finally decided, and as such, the present application for suspension of sentence was kept pending.

The learned counsel for the applicant / appellant, however, submits that, the hearing of the appeal be deferred till 14th December 2015. The Office note shows that amendment has not been carried out in accordance with the order dated 26th October 2015.

Under the circumstances, though I am inclined to defer the hearing of the appeal, as prayed for by the learned counsel for the applicant / appellant, I am not inclined to keep the application for suspension of sentence pending.

Upon going through the evidence recorded during the trial, and the fact that the applicant / appellant had withdrawn his application for suspension of sentence that had been filed previously, I do not think it fit to suspend the sentence imposed upon the applicant / appellant.

The application is rejected.
