The petitioner herein has challenged the order dated 12th April, 2016 whereby the learned Metropolitan Magistrate, Railway Mobile Court, Andheri, Mumbai has issued process under Section 500 of the Indian Penal Code.

The petitioners have alternative efficacious remedy in view of which, Mr. Waseem Pangarkar, learned counsel for the petitioner seeks leave to withdraw the petition with liberty to file a revision application before the Sessions Court alongwith an application for condonation of delay. Leave with liberty is granted. Writ Petition No. 3464 of 2017 is dismissed as withdrawn.
