DSS 13-ao-1034-14@caa-1247-14
IN THE HIGH COURT OF JUDICATURE AT BOMBAY
CIVIL APPELLATE JURISDICTION APPEAL FROM RODER NO. 1034 OF 2014 WITH CIVIL APPLICATION NO. 1247 OF 2014 Shantilal D. Savla and anr.
.. Appellants.
vs.
Vishal S. Savla and anr.
.. Respondents.
Mr. Dinesh C. Shah for the Appellant.
CORAM :
M. S. SONAK, J.
DATE : 8 FEBRUARY 2017.
P.C. :- 1] This appeal questions the impugned order dated 24 July 2014, by which, the ad-interim relief was refused to the appellantsplaintiffs. 2] By now, it was expected that the notice of motion itself has been disposed of. However, Mr. Shah, learned counsel for the appellants, submits that the notice of motion is pending even till date. If this be so, learned trial Judge is directed to dispose of the notice of motion itself within six weeks from today. Such disposal shall be made in accordance with law and on its own merits. Learned trial Judge shall not be influenced by any observations in the impugned order dated 24 July 2014 or the circumstance that this court has not entertained the appeal against the same. The only reason for not entertaining this appeal is because there is no point in deciding a motion for ad-interim reliefs, at this point of time, rather it would be appropriate if the notice of motion itself is disposed of. 1/2
DSS 13-ao-1034-14@caa-1247-14 3] The appeal and civil application are, accordingly, disposed of. 4] All concerned to act on the basis of authenticated copy of this order.
