This Application is preferred by the Plaintiff for condonation of 32 days delay in filing the appeal challenging the judgment and decree dated 28/06/2013 passed by the Bombay City Civil Court, Mumbai in Short Cause Suit No.251/2007. 3.
Considering the submissions made by the learned counsel for the Applicant and the averments made in the Application, I am satisfied that the Applicant has made out a case for allowing the present Civil Application.

Hence, the following order:
A) Civil Application is allowed in terms of prayer clause (a) which read thus "(a) that the delay of 32 days for filing the present appeal be condoned and that the Applicants be allowed to file the present appeal.
B) Civil application stands disposed off accordingly.
