By this appeal, the State of Maharashtra has challenged the Judgment and Order dated 28th March 2013, passed by the learned Additional Sessions Judge, Baramati, Pune in Special Case No.15 of 2012, acquitting the respondent of the offences punishable under Sections 7, 13(1)(d) r/w 13(2) of the Prevention of Corruption Act. 2.

Learned Counsel for the respondent had tendered the Death Certificate of the respondent. The learned APP was asked to verify the said certificate. Today, the learned APP has tendered a report dated 3rd March,

2/2 17-apeal.1059.2013.doc 2021 of Deputy Manager, Birth and Death Registration, Baramati Municipal Council, Baramati, confirming that the respondent has expired. To the said report, the death certificate is annexed. The said report is taken on record.
