The application Exh.109 for referring the document in question to the handwriting expert which has been rejected by the impugned order is taken exception to by way of the above Petition. The said application Exh.109 was filed at the stage when the Defendants arguments in the suit were completed and the suit was placed for the arguments of the Plaintiff. It is also required to be noted that the original, of which the certified copy is obtained, is sought to be sent to the handwriting expert by virtue of the instant application. The original of the said document has not been produced, which it seems is filed in some other proceeding. Considering the stage at which the suit is at present, no fault can be found with the impugned order rejecting the application Exh.109. No case for interference is therefore made out. The Writ Petition is accordingly dismissed.
