The learned Counsel appearing for petitioner submits that petitioner being a tax payer is raising the issue of alleged illegal construction. The subject construction is narrated in the petition and in the representation addressed to the Commissioner annexed at

2/2 17wpl10042.18.doc Exhibit A. In case the representation is still pending we direct the Commissioner, Pune Municipal Corporation to look into the grievance of the petitioner and take necessary steps.

Needless to mention that no adverse order shall be passed without giving notice to the owner/occupier of the subject structure. The Commissioner is at liberty to decide if personal hearing would be necessary.

Without expressing any opinion on the merits of the case, Writ Petition stands disposed of.
