This is an application for relaxation of Condition No.(iii) imposed upon the applicant by an order dated 25.4.2014, while releasing him on bail, by this Court.

2) The learned counsel for the applicant submitted that against the said order dated 25.4.2014 the original complainant namely Rahul Gajanan Thakur had preferred Special Leave to Appeal (Cri.) bearing No.9267/2015 which has been dismissed by the Apex Court by its order dated 26.10.2015. He further submitted that since the date of his release from Jail the applicant is regularly complying with the said condition imposed upon him by order dated 25.4.2014.

3) In view of the facts mentioned in the application and in the interest of justice, I am inclined to allow the present application by modifying the said condition No.(iii) of order dated 25.4.2014. 4) Hence, the following order.

ORDER

a) The Condition to attend the concerned police station on every Sunday between 10.00 a.m. to 12.00 noon, till the conclusion of the trial is hereby modified and the applicant is hereby directed to attend the concerned police station on every 1st Saturday of the month between 10.00 a.m. to 12.00 noon till the conclusion of the trial.

b) Rest of the conditions imposed by order dated 25.4.2014 are not disturbed.

c) Application is allowed in the aforesaid terms. (A.S. GADKARI, J.)
