The Appellant has filed this Appeal challenging the the judgment and order passed by the learned Sessions Judge, Kalyan thereby convicting the Appellant to undergo imprisonment for life.

The learned APP states that instructions have been received that the information supplied by the learned Counsel for the Appellant is correct and a photo copy of the Death Certificate as certified by the Senior Police Inspector, Shivaji Nagar Police Station has been received in the office of the Public Prosecutor. A copy thereof is placed before us. The learned APP confirms that the Appellant has expired and a photo copy of the Death Certificate is taken on record and marked as Exhibit 'X'. 4.

Accepting the joint submission made before us, we dispose of the appeal as abated.
