Mr. Konde-Deshmukh, learned Additional Public Prosecutor raises a preliminary objection. He submits that the petitioner has an alternative efficacious remedy and can agitate his grievance before the Police Complaints Authority. 2.
In view of the objection raised by the learned Additional Public Prosecutor, learned counsel for the petitioner does not press this N. S. Chitnis 1/2
19-wp.3615.2023.doc petition and seeks leave to withdraw the aforesaid petition, which seeks a direction to the respondent to register an FIR as against the concerned police and their Associates, with liberty to file appropriate proceeding before the appropriate forum.

Petition is accordingly disposed of as withdrawn with liberty as prayed.

We make it clear, that we have not heard the aforesaid petition on merits and as such all contentions of all parties are kept open.
